Stop Aggressive Driving - RESOURCES

"The National Highway Traffic Safety Administration (NHTSA) is using the following working definitions as we develop programs and materials on this topic. We define Aggressive Driving as when: "An individual commits a combination of moving traffic offenses so as to endanger other persons or property." This is a traffic offense. Aggressive driving can include a range of less serious traffic offenses up to and including reckless driving.

- Aggressive driving does not necessarily require willful and wanton disregard for the safety of others.

- Aggressive driving is defined as a series of unlawful driving actions such as, but not limited to these examples:
- speeding - exceeding the posted limit and driving too fast for conditions improper lane changing - failing to signal intent, failing to see that movement can be made safely, or, excessive lane changing, improper passing - failing to signal intent, using an emergency lane to pass, or, passing on the shoulder.

- The "aggressive driver."

They are high risk drivers--more likely to drink and drive, speed, or drive unbelted. - Their vehicle provides anonymity, allowing them to take out their frustrations on anybody anytime. - Their frustration levels are high, concern for other motorist is low. - They consider vehicles as objects and fail to consider the human element involved, therefore, they seldom consider the consequences of their actions. - They run stop signs, disobey red lights, speed, tailgate, weave in-and-out of traffic, pass on the right, make unsafe lane changes, go around railroad gates, flash their lights, blow their horns, or, make hand and facial gestures.

- - Aggressive driving vs. Road Rage. There is a difference between aggressive driving, a traffic offense, and road rage, a criminal offense.

- Road rage is defined as "an assault with a motor vehicle or other dangerous weapon by the operator or passenger(s) of one motor vehicle on the operato r or passenger(s) of another motor vehicle or precipitated by an incident that occurred on a roadway."

- Road rage does require willful and wanton disregard for the safety.

NHTSA is the federal agency with responsibility of addressing highway safety issues. Because aggressive driving is normally attributed to traffic offenses, then NHTSA is the only federal agency who is working on this issue.
